The Civil Rights Committee, chaired by Mari Newman, will host a CLE discussion on "Resisting Discovery Stays in Civil Rights Cases" by Raymond Bryant from the Civil Rights Litigation Group.
Discovery stays in Section 1983 cases have become ubiquitous in recent years. Following the Supreme Court’s decisions in Harlow and Iqbal, courts have grown more fond of staying civil rights cases while they evaluate challenges based on qualified immunity. However, these stays are not always warranted and likely cause harm to civil rights plaintiffs in meaningful ways. Join us for a discussion on discovery stays including how courts in our district treat them and how we can fight back against them.
