The Civil Rights Committee, chaired by Mari Newman, will host a CLE discussion on "Pleading and Proving Municipal Liability in Civil Rights" by Michael Fairhurst from Killmer, Lane & Newman.
Fairhurst will discuss how to successfully litigate municipal liability claims under 42 U.S.C. § 1983 against public and private entities pursuant to the principles set forth in Monell v. Department of Social Services of City of New York, 436 U.S. 658 (1978) and its progeny. His presentation will address all phases of the litigation process from pre-filing investigation through trial. He will show you how to properly plead and prove such claims and the types of discovery most likely to elicit relevant and admissible evidence to Monell liability. Fairhurst also will address strategic considerations relating to how and when to pursue Monell claims.
